STEREOPONY live show Sweepstakes

The following Sweepstakes is intended for play in the 50 United States and the District of Columbia only and shall only be construed and evaluated according to United States law.  Do not enter this Sweepstakes if you are not located in the 50 United States or the District of Columbia at the time of entry.

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. PURCHASE DOES NOT IMPROVE CHANCE OF WINNING.

1.         ELIGIBILITY: Open only to legal residents of the 50 United States and the District of Columbia who are age 13 or older, are located in the U.S. at the time of Entry, and have a current, active account on Twitter at the time of Entry.  Employees, contractors, directors and officers of Sony Music Entertainment (“Sponsor”), its parents, subsidiaries, and affiliated companies, distributors, and the advertising, fulfillment, judging and promotion agencies and persons involved in the administration, development, promotion and execution of this Sweepstakes (collectively, “Sweepstakes Parties”), and their immediate family members (spouse, parent, child, sibling and spouse of each) and those living in the same households of each are not eligible to enter or win. Sweepstakes is subject to applicable federal, state and local laws and regulations and is void where prohibited. 

2.         TO ENTER: The Sweepstakes will begin on Apr 9, 2012 at 10:00:01 a.m. P.S.T., and end upon the earlier to occur of the Terminating Tweet (as defined below) or Apr 11, 2012, at 12:59:59 p.m. P.S.T. (the “Sweepstakes Period”).  Sponsor will post a message at “@shonenjump” on Twitter when the Sweepstakes has ended.  By participating, entrants agree to these Official Rules, which are final and binding in all respects.

To enter the Sweepstakes, during the Sweepstakes Period follow @shonenjump on Twitter at the Twitter handle @shonenjump.  You must have or create a non-private Twitter account in order to enter.  If you are not an existing member of Twitter, you will be required to follow the directions and join Twitter.  When you join Twitter, you are indicating that you have read and agree to accept the Twitter Terms of Service and Privacy Policy available at http://twitter.com/tos.  Membership to Twitter.com is free. 

At a random time during the Sweepstakes Period, Sponsor will post a tweet beginning the Sweepstakes (“Initiating Tweet”).  To enter the Sweepstakes, you must follow the instructions in the Initiating Tweet and include in your re-tweet “@shonenjump” and the following hashtag: #Stereopony (“Tweet”) with the correct answer.  You will receive one (1) Sweepstakes entry for your Tweet.  Limit one (1) entry per person/Twitter account for the entire Sweepstakes Period, regardless of the number of Tweets you post.  Approximately one hour after the Initiating Tweet, Sponsor will tweet to its followers a message ending the Sweepstakes ("Terminating Tweet"). All Entries must be tweeted following the Initiating Tweet and prior to the posting of the Terminating Tweet.  Entry must contain the required “@” and “#” tweet language as stated herein.  Entries not in compliance with these Official Rules may be disqualified, in Sponsor’s sole discretion.  Entries will be deemed to have been submitted by the authorized Twitter account holder associated with the username used to enter via Twitter.  The authorized account holder is defined as the natural person who is assigned to a username by twitter.com.  You must enter using only a twitter.com account subscribed to and registered in your name.  The potential winner may be required to provide Sponsor with proof that he/she is the authorized account holder of the user name/Twitter Account associated with the winning entry.  Entries that have been generated by a script, macro, bot or any other automated means will be deemed void.  Participants may not register with multiple email addresses/Twitter accounts nor may entrants use any other device or artifice to register multiple times or as multiple registrants. Any entrant who attempts to enter with multiple twitter accounts under multiple identities will be disqualified and forfeits any and all prizes won, in Sponsor's discretion.  Proof of submission of an entry shall not be deemed proof of receipt by the Sponsor.  Twitter's computer is the official time keeping device for the Sweepstakes.

3.         PRIZE:  There will be three (3) winners randomly selected from the valid entries.  Each winner will receive two (2) tickets to STEREOPONY live show. Approximate Retail Value of each prize (“ARV”):  $25.00 USD.  Total ARV: $150.00 USD.  All expenses not specifically set forth herein are winner's sole responsibility.  No substitution, cash redemption or transfer of prize is permitted except at Sponsor’s sole discretion.  If prize, or any portion thereof, cannot be awarded for any reason, Sponsor reserves the right to substitute prize with another prize of equal or greater value. Any portion of the prize not accepted by winner shall be forfeited. ARV is as of date of printing of these Official Rules.  The difference in value of prize as stated herein and value at time of prize notification, if any, will not be awarded.  All taxes on prizes are the sole responsibility of winner.

4.              WINNER SELECTION & NOTIFICATION: On or about Apr 11, 2012, Sponsor and/or its designee(s) will select three (3) winners at random from all eligible entries received after the Initiating Tweet and prior to the Terminating Tweet.  Odds of winning depend upon the number of eligible Entries received.  Becoming a Winner is subject to validation and verification of eligibility and compliance with all terms and conditions set forth in these Official Rules.  Potential winners will be notified via email sent to the Twitter account associated with the Entry and follow up prize correspondence will take place through certified postal mail or e-mail. If any prize correspondence (including e-mail) is returned as non-deliverable, or if no reply is received from the potential winner, or if the winner is otherwise disqualified for any reason, prize may be forfeited and an alternative winner may be selected.  Unclaimed prizes will not be awarded.  Winner (or winner’s parent or legal guardian, if winner is a minor in his/her state/province of residence) may be required to complete, in Sponsor’s sole discretion, sign and return an Affidavit/Declaration of Eligibility/Liability Release, and, where lawful, a Publicity Release within ten (10) days of attempted notification or prize may be forfeited and an alternate winner selected.  If no documentation from Winner is required by Sponsor, tickets will be picked up at Will Call for each show. Prizes won by an eligible entrant who is a minor in his/her state of residence will be awarded to minor’s parent or legal guardian.  Sponsor is not responsible for any change in the entrant's mailing address, email address, Twitter account information and/or telephone number.

5.              GENERAL CONDITIONS: Prize will be awarded only to an address within the 50 United States or the District of Columbia. By participating, entrants (and their parent(s)/legal guardian(s) if entrants are minors) agree to these Official Rules, and to the Sponsor's decisions, which are final and binding in all respects.

By participating in the Sweepstakes, except where prohibited by law, the Winner(s) agree to have their name, voice, or likeness used in any advertising or broadcasting material relating to this Sweepstakes without additional financial or other compensation, and to sign a publicity release confirming such consent prior to acceptance of the prize.

Sweepstakes Parties are not responsible for: (i) electronic transmissions or entries that are lost, late, stolen, incomplete, illegible, damaged, garbled, destroyed, misdirected or not received by the Sponsor or its agents for any reason, (ii) any problems or technical malfunctions, errors, omissions, interruptions, deletions, defects, delays in operation or transmission, communication failures or human error that may occur in the transmission, receipt or processing of entries, or for destruction of or unauthorized access to, or alteration of, entries (iii) failed or unavailable hardware, network, software or telephone transmissions, damage to entrants’ or any person’s computer or cell phone and/or its contents, or causes beyond Sweepstakes Parties’ reasonable control that jeopardize the administration, security, fairness, integrity or proper conduct of this Sweepstakes: (iv) any entries submitted in a manner that is not expressly allowed under these rules (all such entries disqualified); (v) incorrect or inaccurate entry information whether caused by entrants or by any of the equipment or programming associated with or utilized in the Sweepstakes, or (vi) any typographical or other errors in the printing, the offering or the administration of the Sweepstakes, or in the announcement of a prize.  Sponsor’s decisions are final and binding on all matters relating to this Sweepstakes.  Sponsor reserves all rights, including the right to edit, publish, use, adapt, modify, or dispose of any Entry, for advertising and promotional purposes in all media (including, but not limited to, the internet) without limitation or additional compensation. This promotion is in no way sponsored, endorsed or administered by, or associated with, Twitter.  Please see the privacy policy located at www.sonymusic.com/privacy-policy for detail of Sponsor’s policy regarding the use of personal information collected in connection with this Sweepstakes.

If for any reason this Sweepstakes cannot be executed as planned, including but not limited to infection by computer virus, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sweepstakes Parties that corrupt or affect the security, administration, fairness, integrity or proper conduct of this Sweepstakes, or if the Sweepstakes is compromised or becomes technically corrupted in any way, electronically or otherwise, the Sweepstakes Parties reserve the right to cancel, terminate or modify the Sweepstakes.  If Sweepstakes is terminated before the original end date, Sponsor will select the winners by random drawing from among all eligible non-suspect Entries received as of the termination time/date.  Sponsor reserves the right, at its sole discretion, to disqualify and prosecute any individual who tampers with or attempts to tamper with the entry process or the operation of the participating stations’ websites or who enters using any automatic or programmed entry duplication method that is prohibited under these rules.  CAUTION: ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE ANY WEB SITE OR OTHERWISE CORRUPT OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS, SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO DISQUALIFY, PROSECUTE AND SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

Failure to comply with the Sweepstakes rules may result in an entrant’s disqualification solely at the discretion of the Sponsor. 

6.              DISPUTES & GOVERNING LAW: As a condition of participating, entrants (or their parent or legal guardian if an eligible minor) agree (and agree to confirm in writing): (a) to release Sweepstakes Parties from any and all liability, loss or damage incurred with respect to the awarding, receipt, possession, and/or use or misuse of any prize, (b) that under no circumstances will participant be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses; (c) all causes of action arising out of or connected with this Sweepstakes, or any prize awarded, shall be resolved individually, without resort to any form of class action; and (d) any and all claims, judgments, and award shall be limited to actual out-of-pocket costs incurred, excluding attorneys’ fees and court.  By entering, entrants agree that all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, participant’s rights and obligations, or the rights and obligations of the Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of State of California, without giving effect to any choice of law or conflict of law rules.  By entering, entrants consent to the jurisdiction and venue of the federal, state and local courts for San Francisco, California.
